Rental Terms and Conditions
Effective Date: July 15, 2026
By completing a booking with Borrow the Magic LLC (“Borrow the Magic,” “we,” “us,” or “our”), you (“Customer”) agree to the following terms and conditions. Please read them carefully before confirming your reservation.
About the Service
Borrow the Magic is a curated theme park accessory rental service operating in the Orlando, Florida area. Customers book items online through our Booqable-powered website. Items are delivered to bell services at your resort or hotel ahead of your stay, and you simply request them from bell services after check-in. Returns are made to bell services at checkout. Borrow the Magic does not ship items directly to customers; all orders are fulfilled through resort bell services only.
Booking and Payment
All reservations are made online through the Borrow the Magic website. The name on your order must match the name on your hotel or resort reservation. Bell services may cross-reference these names at pickup, and a mismatch could prevent you from receiving your items. By completing a booking, you authorize Borrow the Magic to place a hold on your credit card at the time of booking. This hold covers potential damage or loss charges as described in the Damage Protection and Loss Policy section. Your card will not be charged the rental fee until your order is confirmed.
If a damage or loss charge cannot be processed on the card on file (for example, due to a decline or expiration), Borrow the Magic will attempt to recharge the card and will contact you to provide an alternative payment method. Customers will be given a reasonable deadline to resolve outstanding charges. Any outstanding charges shall accrue interest at the highest rate allowed pursuant to Florida law. Borrow the Magic reserves the right to pursue payment by any lawful means. Unresolved balances may be sent to an external collections department, or may be handled by Borrow the Magic’s legal team, and may also affect eligibility for future bookings. Customer shall be responsible for any attorneys’ fees and costs incurred by Borrow the Magic related to collecting on unresolved balances owed hereunder.
Your credit card hold will be released once your returned items have been inspected and no damage beyond normal wear has been found. Inspections typically take place within 1-3 business days of return.
By booking with Borrow the Magic, you consent to receive text messages and emails related to your order, including delivery confirmations (which may include a photo of your items at bell services), pickup instructions, and any communication regarding issues with your order. These are operational messages related to your active order and are not marketing communications, so replying STOP will not opt you out of them. If you would prefer to receive these communications by email only, please contact us directly and we will update your preference.
Rental Periods and Pricing
The rental period begins when your items are confirmed delivered to bell services at your resort, and ends at the end of your stated checkout date, unless otherwise noted on your order confirmation. Late returns may result in additional charges billed at the applicable per-day rate. If an item is not returned within 7 days after the end of the rental period, it will be considered lost and charged in accordance with the Damage Protection and Loss Policy section.
Rental pricing is tiered by item retail value and rental duration:
1-5 Day Rentals:
- Tier 1 (retail $0–$30): $8 flat
- Tier 2 (retail $31–$60): $15 flat
- Tier 3 (retail $61–$120): $30 flat
- Tier 4 (retail $121–$250): $62 flat
- Tier 5 (retail $251–$500): $122 flat
- Tier 6 (retail $501+): $242 flat
6-10 Day Rentals:
- Tier 1 (retail $0–$30): $8 flat
- Tier 2 (retail $31–$60): $19 flat
- Tier 3 (retail $61–$120): $36 flat
- Tier 4 (retail $121–$250): $78 flat
- Tier 5 (retail $251–$500): $153 flat
- Tier 6 (retail $501+): $303 flat
11+ Day Rentals:
- Charged at a per-day rate by tier: Tier 1: $3 / Tier 2: $4 / Tier 3: $7 / Tier 4: $14 / Tier 5: $26 / Tier 6: $52 per day
A $5 damage protection waiver is available on all orders and is strongly encouraged. See the Damage Protection and Loss Policy section for details.
Delivery and Return
Items are delivered to bell services at your resort prior to your stay. You will receive confirmation once delivery is complete, along with instructions for requesting your items from bell services. At the end of your rental period, items must be returned to bell services at checkout in the same condition received, including all original tags, straps, and accessories.
If we are unable to complete delivery due to circumstances such as an incorrect resort or reservation name, early checkout, any unforeseen event outside the control of Borrow the Magic, or bell services declining the delivery, we will attempt to contact you to resolve the issue. If delivery cannot be completed for reasons outside our control, rental fees will be refunded in accordance with the Cancellations and Refunds section, and Customer shall be afforded no other recourse hereunder.
Our delivery confirmation log serves as the record of items delivered to bell services. If a discrepancy arises regarding items received, this log will be used to resolve the dispute.
Damage Protection and Loss Policy
Damage Protection Waiver
For a flat fee of $5, customers may add a damage protection waiver to their order. This waiver covers the cost of repairing an item that is accidentally damaged during normal use, where the item can be restored to rentable condition (for example, cleaning, mending, restringing, or similar repairs). When the damage protection waiver applies and the item is repairable, the customer pays nothing for the repair.
The damage protection waiver shall only apply to repairs that can be reasonably made in the sole discretion of Borrow the Magic. If, in Borrow the Magic’s sole discretion, an item is damaged beyond repair and must be replaced, or if an item is lost, the waiver shall not apply and the standard damage and loss charges described below will apply instead. Further, the waiver shall not afford coverage for intentional damage, damage from gross negligence as to the use of said item, or damage resulting from a prohibited use of said item.
Damage and Loss Charges
Items are inspected for damage within 1-3 business days after return. All items are photographed before and after each rental. In the event of damage beyond normal wear, or loss of any item, the following applies:
- Damage or loss is charged at the item's estimated current replacement value, based on the cost to acquire a comparable replacement item at the time of the claim. This may differ from the item's original retail price. A $25 administration fee and a restocking fee of 10% of the item's replacement value shall also apply.
- If no reasonable replacement is available for purchase, Borrow the Magic will charge a flat fee of $100 per item, plus the $25 administration fee.
- Charges will be applied to the credit card on file. You will be notified before any charge is processed.
- Customers who purchased the damage protection waiver will not be charged for repairs to accidentally damaged items that can be restored to rentable condition, as described above.
- Items must be returned in the same condition as received, free of stains, spills, or damage beyond normal handling wear.
Normal Wear
The following are considered normal wear and will not generally trigger damage charges. Borrow the Magic reserves the right, in its sole discretion, to make the final determination at inspection:
- Minor scuffs or surface marks consistent with careful, ordinary use
- Light fading or discoloration from sun exposure
- Minor pilling, fraying, or loose threads on plush, fabric, or bag items
- Light scratches on hard surfaces such as acrylic ears, sunglasses, or jewelry
- Minor elastic stretching on headbands, bows, or hair accessories
- Residue from sunscreen, sweat, or typical Florida heat and humidity exposure
Cancellations and Refunds
Cancellations must be submitted in writing via email to our customer service address. The following refund schedule applies:
- 7 or more days before the rental start date: Full refund
- 3–6 days before the rental start date: 50% refund
- Less than 48 hours before the rental start date: No refund
Borrow the Magic reserves the right to cancel any order due to inventory unavailability or circumstances beyond our control. In such cases, a full refund will be issued, and Customer shall be afforded no other recourse hereunder.
Refunds are issued to the original payment method. Processing times are determined by our payment platform and may take several business days to appear on your statement.
Force Majeure
Borrow the Magic is not liable for delays, cancellations, or failure to deliver or accept return of items due to causes beyond our control, including, but not limited to, hurricanes, severe weather, natural disasters, wars or conflicts, pandemics/epidemics, embargoes, supply chain issues, government action, resort/park closures, or any other event that is outside Borrow the Magic’s control, regardless of whether such event was reasonably foreseeable. If such an event prevents delivery of your order, Borrow the Magic will refund the rental fee and release any associated damage hold in full, and Customer shall be afforded no other recourse hereunder.
Item Condition and Care
All Borrow the Magic rental items are inspected and cleaned between each rental. By accepting your order, you confirm that items are received in satisfactory condition. Any pre-existing damage must be reported to Borrow the Magic within 24 hours of confirmed receipt from bell services.
Rental items are provided on an as-is, where-is, with all faults basis. While we make reasonable efforts to accurately represent each item's appearance, color, and condition on our website, slight variations may occur due to photography, lighting, screen display, or natural variation between individual items. Borrow the Magic does not guarantee fit, exact color match, or availability of any specific item beyond what is confirmed at the time of booking.
Your order is intended for your own personal use during your stay. Rental items may not be re-rented, resold, used for commercial purposes (including paid content creation or brand partnerships), or shared with guests outside your party without our prior written consent.
Customers agree to:
- Handle all items with reasonable care during the rental period
- Return all items and components received (tags, straps, accessories, etc.)
- Not lend, sublease, or transfer rental items to any third party
Liability Disclaimer
Borrow the Magic LLC is not affiliated with, endorsed by, or sponsored by Walt Disney World, Universal Orlando Resort, Disney Cruise Line, or any related entities. Borrow the Magic is not responsible for any injury, loss, theft, or damage that occurs during your visit to any theme park, resort, or cruise departure, regardless of any negligence by Borrow the Magic or Borrow the Magic’s owners, employees, agents, or officers. Use of rental items at theme parks and related venues is entirely at your own risk to which you agree to indemnify and hold Borrow the Magic harmless.
Limitation of Liability. Borrow the Magic's total liability to any customer is limited to the amount paid for the applicable rental order.
Indemnification
You agree to indemnify and hold Borrow the Magic LLC, its founders, and its representatives harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of rental items, your violation of these Terms, or any unauthorized transfer or commercial use of rental items by you or anyone in your party.
Photo and Content Release
Customers who tag @borrowthemagic_ or use our branded hashtags on social media grant Borrow the Magic LLC a non-exclusive, royalty-free license to repost, share, or feature that content across Borrow the Magic's social media channels and marketing materials. We will always credit the original creator when reposting.
Borrow the Magic will not repost or feature any content that visibly includes a minor without explicit written consent from a parent or legal guardian. If your content includes a minor and you would like it considered for reposting, please contact us directly. If you would prefer your content not be shared at all, please notify us at the time of posting or contact us directly.
Governing Law
These terms and conditions are governed by the laws of the State of Florida. Any disputes arising from or related to your rental agreement with Borrow the Magic LLC shall be resolved in the courts of Orange County, Florida.
Changes to Terms
Borrow the Magic reserves the right to update these terms at any time. Updated terms will be posted on our website with a revised effective date. Continued use of our services after any update constitutes acceptance of the revised terms.
Assignment
Customers may not transfer or assign their rental agreement to any other person. Borrow the Magic may assign these terms in connection with a merger, acquisition, or sale of all or substantially all of its business assets.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These terms, together with your order confirmation, constitute the entire agreement between you and Borrow the Magic LLC regarding your rental, and supersede any prior or contemporaneous representations, whether written or verbal, made by Borrow the Magic or its representatives.
