This Privacy Policy describes how Borrow the Magic LLC ("Borrow the Magic," "we," "us," or "our"), a Florida limited liability company, collects, uses, discloses, and protects the personal information you provide when you use our website, book our rental services, or otherwise interact with us. By using our services or providing us with your personal information, you agree to the practices described in this Privacy Policy.
Article 1 — Definitions
- "Personal Information" means information that identifies, relates to, describes, or is capable of being associated with a particular individual, including but not limited to name, email address, phone number, billing address, payment information, and reservation details.
- "Services" means the rental services, website, booking platform, and related services provided by Borrow the Magic.
- "You" or "Your" means the individual using our Services or providing Personal Information to us.
- "Process" or "Processing" means any operation performed on Personal Information, including collection, use, storage, disclosure, transfer, and deletion.
- "Third-Party Service Providers" means vendors, partners, and service providers that we engage to support our business operations.
Article 2 — Scope and Application
- Applicability. This Privacy Policy applies to all Personal Information collected by Borrow the Magic through our website, booking system, email communications, text messages, and any other means in connection with our Services.
- Florida Law Compliance. As a Florida-based business, Borrow the Magic complies with applicable Florida data privacy laws, including the Florida Information Protection Act of 2014 (Fla. Stat. § 501.171), the Florida Digital Bill of Rights (effective July 1, 2024, Fla. Stat. § 501.704), and other applicable state and federal privacy regulations.

Article 3 — Personal Information We Collect
- Information Collected Directly from You. When you book our Services, create an account, or communicate with us, we collect the following categories of Personal Information directly from you:
- Identity and Contact Information. Full name, email address, cell phone number, and billing address.
- Payment Information. Billing address and payment card information, which is processed securely through our third-party payment processor. Borrow the Magic does not store full payment card details on our systems.
- Reservation Details. Resort or hotel name, reservation number, the name on your hotel reservation, check-in and check-out dates, and room or accommodation details used to coordinate delivery to and return from bell services.
- Communications. Any information you provide when you contact us via email, text message, phone, or through our website, including the content of your messages and your contact preferences.
- Information Collected Automatically. When you visit our website or use our Services, we automatically collect certain technical and usage information through cookies and similar tracking technologies:
- Device and Browser Information. IP address, browser type and version, device type, operating system, and unique device identifiers.
- Usage Data. Pages visited, time spent on pages, links clicked, referring website addresses, and other website navigation and interaction data.
- Location Information. General geographic location derived from your IP address.
- Information from Third Parties. We may receive Personal Information about you from third parties, including:
- Resorts and Hotels. We may receive confirmation of your reservation details from the resort or hotel where you are staying to facilitate delivery and pickup coordination.
- Service Providers. Our third-party service providers, such as our booking platform and payment processor, may share information with us in connection with providing Services to you.
- Photographic Documentation. We take photographs of rental items before and after each rental period for damage documentation purposes. These photos are associated with your order but contain images of the rental equipment, not of you personally. Photos are retained for 90 days after the end of your rental period, unless they are needed longer to resolve an active damage or loss dispute, in which case they are retained until the dispute is resolved.
- Children's Information. Our Services are not directed to children under the age of 13, and we do not knowingly collect Personal Information from children under 13. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at the email address provided in Article 12, and we will promptly delete such information.
Article 4 — How We Use Your Personal Information
- Primary Purposes. We use your Personal Information for the following purposes:
- Order Fulfillment. To process and fulfill your rental orders, including verifying your reservation, coordinating delivery and pickup with resort bell services, and managing rental inventory.
- Customer Communications. To send order confirmations, rental reminders, delivery notifications, pickup coordination messages, and other transactional communications related to your order.
- Customer Service. To respond to your inquiries, provide customer support, and address issues or concerns you raise.
- Damage and Loss Management. To document the condition of rental items, investigate damage or loss claims, and contact you regarding damage, loss, or billing matters.
- Payment Processing. To process payments, issue refunds, and manage billing matters.
- Marketing and Promotional Purposes. With your consent (as described in Article 5), we may use your contact information to send you promotional offers, discounts, announcements, and updates about Borrow the Magic.
- Business Operations and Improvement. We use your Personal Information to:
- Improve and optimize our Services, website experience, and customer service.
- Analyze booking trends, customer preferences, and service performance.
- Develop new products, services, and features.
- Conduct internal research and data analysis.
- Legal Compliance and Protection. We may use your Personal Information to:

- Enforce our terms of service, rental agreements, and other policies.

- Aggregated and De-Identified Data. We may aggregate or de-identify your Personal Information so that it can no longer reasonably be used to identify you. We may use and share such aggregated or de-identified data for any purpose, including to understand general booking trends, improve our Services, and conduct market research. We will not attempt to re-identify such information except as permitted by law.
Article 5 — Communication Preferences and Consent
- Text Message (SMS) Consent. By completing a booking with Borrow the Magic, you expressly consent to receive text messages (SMS) from us at the cell phone number you provide.
- Types of Messages. Text messages may include:
- Order confirmations and booking updates.
- Delivery confirmations, including photos of your items at bell services.
- Pickup and return coordination.
- Delivery status and scheduling notifications.
- Promotional offers and announcements.
- Message Frequency and Rates. Message frequency will vary based on your order activity. Standard message and data rates may apply based on your mobile carrier plan.
- Operational vs. Promotional Messages. Operational messages related to an active order (such as delivery confirmations and pickup coordination) are necessary to fulfill your order and are not marketing communications. Replying STOP to operational messages will not opt you out of receiving them, as they are essential to providing the Services you requested.
- Opting Out of Promotional Messages. To opt out of promotional text messages only, reply STOP to any promotional message. If you prefer to receive operational communications by email only, please contact us at the email address provided in Article 12, and we will update your communication preferences.
- Questions. For questions about our text messaging practices, contact us at the email address provided in Article 12.
- Email Communications. By providing your email address, you agree to receive transactional emails related to your order, including order confirmations, delivery updates, and customer service communications.
- Promotional Emails. We may also send you promotional emails about Borrow the Magic offers, services, and updates.
- Opting Out. You may opt out of promotional emails at any time by clicking the "unsubscribe" link included in any promotional email or by contacting us directly at the email address provided in Article 12.
- Transactional Emails. Transactional emails related to active orders cannot be opted out of, as they are necessary to provide the Services you have requested.
Article 6 — How We Share Your Personal Information
- No Sale of Personal Information. Borrow the Magic does not sell your Personal Information to third parties.
- Sharing with Service Providers. We share your Personal Information with Third-Party Service Providers who perform services on our behalf, including:
- Booking and Inventory Management. Booqable, our booking and inventory management platform, receives your name, email address, billing address, phone number, and payment information to process your reservation. Booqable's privacy practices are governed by their privacy policy available at booqable.com/privacy.
- Payment Processing. Our PCI-compliant payment processors receive and process your payment information to complete transactions. We do not store full payment card details on our systems.
- Email Marketing. Klaviyo, our email marketing platform, may receive your name and email address to send order-related and promotional communications. Klaviyo's privacy practices are governed by their privacy policy available at klaviyo.com/legal/privacy.
- Analytics. Google Analytics collects anonymized data about website usage, such as pages visited, time on site, and general location information. Google Analytics does not collect personally identifiable information. Google's privacy practices are governed by their privacy policy available at policies.google.com/privacy.
- Advertising. We use Meta Pixel (Facebook/Instagram) to measure advertising effectiveness and reach relevant audiences on social media platforms. Meta Pixel may collect information about your website activity. You can manage your ad preferences at facebook.com/ads/preferences. Meta's privacy practices are governed by their privacy policy available at facebook.com/privacy/explanation.
- Internal Access. Borrow the Magic is a small team. Your Personal Information may be accessed by our co-founders and by team members or assistants who support order fulfillment and operations, solely as needed to process your order, coordinate delivery and returns, and provide customer service.
- Resorts and Hotels. We may share limited information with the resort or hotel where you are staying, such as your name and reservation details, to coordinate delivery and pickup of rental items through bell services.
- Legal and Protective Disclosures. We may disclose your Personal Information when we believe in good faith that disclosure is necessary to:
- Comply with applicable laws, regulations, legal processes, or enforceable government requests.
- Enforce our terms of service, rental agreements, and policies, including investigation of potential violations.
- Detect, prevent, or address fraud, security, or technical issues.
- Protect against harm to the rights, property, or safety of Borrow the Magic, our users, or the public as required or permitted by law.
- Business Transfers. In the event of a merger, acquisition, reorganization, sale of assets, or bankruptcy, your Personal Information may be transferred to a successor entity. We will provide notice before your Personal Information is transferred and becomes subject to a different privacy policy.
- With Your Consent. We may share your Personal Information for other purposes with your express consent or at your direction.

- Payment Security. Payment information is processed through secure, PCI-compliant third-party payment processors and is never stored directly by Borrow the Magic.
- Access Controls. Access to Personal Information is limited to employees, contractors, and service providers who need the information to perform their job functions.
- Encryption. We use industry-standard encryption technologies to protect sensitive data during transmission.
- No Guarantee of Absolute Security. While we strive to protect your Personal Information, no method of transmission over the internet or electronic storage is completely secure. We cannot guarantee absolute security of your Personal Information.
- Breach Notification. In the event of a data security breach that compromises your Personal Information, we will provide notice to affected individuals in accordance with applicable Florida and federal law, including the Florida Information Protection Act (Fla. Stat. § 501.171). Notice will be provided without unreasonable delay and will include information about the nature of the breach, the types of information affected, steps we are taking to address the breach, and steps you can take to protect yourself.

- Retention Period. We retain your Personal Information for as long as necessary to fulfill the purposes described in this Privacy Policy, comply with legal obligations, resolve disputes, and enforce our agreements.
- Active Customer Data. Personal Information associated with active bookings and customer accounts is retained for the duration of the customer relationship and for a reasonable period thereafter to address customer service issues, process refunds, and manage potential disputes.
- Photographic Documentation. Before-and-after rental photos are retained for 90 days after the end of your rental period, unless they are needed longer to resolve an active damage or loss dispute, in which case they are retained until the dispute is resolved.
- Legal and Regulatory Requirements. We may retain certain Personal Information for longer periods when required by law, including tax, accounting, and other regulatory requirements.
- Deletion Requests. If you would like to request deletion of your Personal Information, please contact us at the email address provided in Article 12. We will respond to your request within 30 days. Please note that we may retain certain information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.
Article 10 — Your Privacy Rights
- Florida Resident Rights. As a Florida-based business, we provide Florida residents with the following rights under the Florida Digital Bill of Rights (Fla. Stat. § 501.704):
- Right to Access. You have the right to request confirmation of whether we are processing your Personal Information and to access the Personal Information we hold about you.
